Xmas Day Offences 2023 (FOI Ref: 1898A 24)
Request
Q1: I would like to request a full list of crimes reported in Birmingham on Christmas Day, December 25 last year (2023). If it's possible to include the name of crime, gender of the victim, suspect, ages and the outcome, that would be appreciated.
Q2: If it's possible to include street addresses, that would be helpful. But failing this, the area which the crime took place in would be fine.

In relation to question 2, street locations are available but have been exempted by virtue of S40 (2) Personal Data. We have however, provided the neighbourhood policing area.
Section 40(2) is an absolute and class-based exemption if to release the information exists would breach the third party’s data protection rights. In this case to release this personal information would not constitute fair processing of the data. If the individual street data was provided then it may lead to an individual being identified. As this exemption is class based I am not required to identify the harm in disclosure and in this instance, I believe that the right to privacy outweighs any public interest in release
